Massachusetts judge rules on video evidence in Brian Walshe Deter

A Massachusetts judge in the trial of Brian Walshe’s murder ruled Monday that prosecutors can show jurors the footage of the missing family home in Cohasset, after lawyers argued the footage was too inflammatory.

Prosecutors wanted to show the entire video to show the connection between the victim and the machine itself. They said in court that a rug found in the same workshop was identical to one found 40 kilometers from Brian Walshe’s mother’s lake near Brian Walshe’s mother, Diana, and a “piece of bone.”

Brian Walshe, a 50-year-old convicted felon, is accused of murdering his wife Ana after learning she was having an affair. Prosecutors said they believed she would have a better chance of avoiding state prison time for a felony conviction if she became the sole custodian of their three children.

He entered the courtroom at 9:5 a.m. Monday, carrying a stack of equipment and wearing a blue suit and blue tie. The court official opened his pores when he reached the defense table.

He said the case will be brought to a close. He warned the defense that anything Walshe’s lawyers plan to use in their opening statement must be shared with the Court and the Prosecution before it is shown to jurors. He agreed to a defense request to add questions to the Juror Questionnaire, including the first one asking if any jurors could agree not to use social media or watch the news during the trial.

He also allowed prosecutors to add some evidence of Brian Walshe’s conviction to show their motive, but said he would not allow other local investigators to be found on his surveillance bracelet, which he said he was getting “a small amount of.”

The judge also said he may allow statements from Ana Walshe’s friend, Melissa Kirby, surrounding a conversation the two had on December 29, three days before Ana Walshe was last seen alive. They discuss Ana Walshe giving her husband an “ultimatum” and arguing over Christmas.

The judge ruled this interview on evidence of both the motive and the attitude of Ana Walshe not long ago.

Her remains were never found, but prosecutors say Brian Walshe killed her, robbed her and hid evidence. The defendant pleaded guilty.
