The Manhattan District Attorney’s Office announced that it intends to prosecute Pedro Hernandez, This man was found guilty of kidnapping and killing a 6-year-old boy 6 decades ago.
Etan Patz went missing in 1979 after leaving his bus to make his first stop in New York City. He was one of the first missing children to appear on milk cartons.
Hernandez pleaded guilty to the crime nearly three decades later, and was sentenced to 25 years for the crime after being convicted of murder in 2017. His first trial ended in a hung jury in 2015.
“The District Attorney has determined that this available, admissible evidence supports the defendant’s prosecution of second-degree murder and first-degree murder, and the People are willing to proceed,” People Help District Assistant Sara Marquez wrote in a statement.

Hernandez’s defense attorneys, Harvey Whidowbein and Alice Fontier, told The Associated Press that they “remain convinced that Mr. Hernandez is an innocent man.”
“But we will be ready for trial and we will present a more robust defense,” the pair’s lawyer added.
The US Court of Appeals for the Second Circuit overturned Hernandez’s conviction in July, finding that the jury in 2017 did not receive an adequate explanation of its options, including whether to marry Hernandez.

Years before his conviction, Hernandez admitted to police that he had cried for Patz in the basement of the convenience store where he worked. Prosecutors say Hernandez chased after Patz, smeared her body in a plastic garbage bag hidden inside the box and took it out with the garbage.
The Court of Appeals found that the trial judge had issued “clearly issued” and “clearly issued” orders in response to the charge of the suspect’s confession to the police.
In October, Judge Collen McMahon of the US District Court for the US District of New York decided that Hernandez would receive a third trial on June 1, or he would eventually be released.
