Green card immigration laws are under scrutiny after the Afghan shooting incident

The order highlights the legal ways in which a green card – a permanent residence permit granted through a status application – can be revoked, and those who cannot.

There are several ways to rescind a legal stay that can be revoked.

First, green card holders can be put on trial if they are found guilty of certain crimes – including serious crimes such as murder, drug abuse, and criminal convictions, depending on the sentence and time.

And they can lose their green cards more than just for terrorism or foreign government surveillance. Green card holders are also unable to vote in federal elections, and convictions linked to attempts to do so may also result in the revocation of their residency status.

The second basis for revocation is proof that the noncitizen obtained the green card through fraud or misrepresentation.

Examples include foreign nationals using identity theft, named in their programs or omitting parts of their criminal history or previous contacts with former immigration authorities.

USCIS may also review adjustment of status applications for legal residents whose marriages end in divorce within two years. The agency can return a green card if it is obtained from a national who marries a US citizen strictly in order to achieve residency.

Home address issues and questions from where – including where in the country – a green card holder actually resides can be areas of disqualification.

Permanent permanent residents must be just that: people who live permanently in the US with a residence to begin with.

Under Ina, receiving public benefits does not make a noncitizen deportable. They must have been charged to the public within five years of admission “due to causes not verifiably shown to have arisen since admission.” This Level is rarely destroyed.

In addition, it is appropriate for example, any non-Afghan who has been arrested or deported to the US, or removed as a “cost” or at the expense of the government in lieu of deportation, is likely to hold a green card.
