Family of Chicago Cop Files Diem Dead Suit After Shot by Partner

The family of a Chicago police officer who shot his partner during a pursuit earlier this year has filed a wrongful-death lawsuit, accusing the department of ignoring clear warning signs that the officer was threatening him.

The lawsuit, filed by Officer Krystal Rivera’s mother, claims the Chicago Police Department knew Chief Carlos Baker had a history of bad behavior and misconduct but continued to hire him to work with Rivera. Rivera, 36, was shot and killed on June 5 while the pair were trying to apprehend an armed suspect.

According to the complaint, Rivera repeatedly raised concerns with management about Buker’s behavior and maintained an on-again, off-again relationship with him before the shooting. The lawsuit says the department was aware of several complaints against Baker, including allegations from a girlfriend who accused him of threatening her with a gun inside a bar.

Rivera’s mother, Yolanda, said her daughter was never afraid of the person assigned to kill her. “Krystal understood the dangers of this job. She accepted the dangers that came with the police. What she didn’t have to fear was her partner,” she said. “Betrayal cost Krystal her life.”

The case is alleged that Rivera and Baker pulled over a driver who was suspected of having a weapon, and then gave chase on foot that ended up outside the apartment building. Baker kicked in the door and fired his weapon at the suspect but hit Rivera in the back instead.

Family Attorney Antonio Romanucci said Baker then ran downstairs rather than call for help or provide any first aid.

“He didn’t even try basic first aid to apply pressure to her wound… Baker left Krystal there on the floor, Krystal on the radio.

The lawsuit also accuses the department of filing misleading reports to state regulators suggesting the gun came from a banned suspect rather than a baker.

Romanucci said the baker’s 11 complaints in three years put him in the small percentage of police officers with the worst police records. In another incident in 2022, a baker allegedly fired a gun at an old building inside a tavern – a case reviewed by the civil police accountability office, which did not issue a formal ruling.

Rivera joined CPD in 2021 and was paired with Baker in early 2023. The two began a romantic relationship in the summer, but later Mvumulo asked for a new partner for what Baker’s said was “before serious behavior. Although this request was granted, the two were reinstated last year after being transferred to the tactical group.

According to the complaint, Rivera ended the relationship last winter after finding out the baker had a live-in girlfriend. He told colleagues he feared a “negative and negative reaction” from Baker, who he said continued to show up at his home late on June 4 – one day before the shooting.

Romanucci argued with the baker that he should not continue wearing the uniform. “He should not have passed his probationary period. He was not fit to police our communities, let alone carry a gun under the color of the law,” he said. “The decision CPD made to put Carlos Baker on the force cost him dearly. It was murder.”

The COCK County state’s attorney previously declined to prosecute the baker, but Rivera’s family hopes new information revealed during the trial will lead prosecutors to reconsider.

Rivera, described by colleagues as a dedicated mentor and rising officer, was in his fourth year with the department.
